Birthday Party Waivers

Every child attending a birthday party at Align Gymnastics needs a signed Child Participation Waiver from a parent or legal guardian. Any adult who will be on the gym floor must also sign the Adult Floor Access Waiver further down this page. Please read each agreement, complete the form below it, and click Submit.

Part 1: Child Participation Waiver

BIRTHDAY PARTY MINOR PARTICIPATION AGREEMENT, ACKNOWLEDGMENT OF RISKS, PARENT/GUARDIAN CONSENT & RELEASE

1. PARENT/GUARDIAN AUTHORITY AND CONSENT

I represent that I am the parent or legal guardian of the minor child identified in the form below and have legal authority to authorize the child’s participation in activities at Align Gymnastics, LLC ("Align Gymnastics" or "Align").

I voluntarily authorize my child to participate in birthday party gymnastics and recreational activities conducted by Align Gymnastics, subject to the facility’s rules, staff instructions, and applicable participation requirements. I understand that participation is available to children ages three (3) and older and that the nature of the activities may vary by party.

2. DESCRIPTION OF ACTIVITIES

Birthday party activities may include structured gymnastics instruction, supervised recreational gymnastics, gymnastics-based games, obstacle courses, tumbling, jumping, balancing, climbing, and other physical activities approved by Align Gymnastics staff.

Depending on the party format, designated equipment may include gymnastics mats, floor exercise areas, balance beams, bars, vaulting or related apparatus, Tumbl Trak equipment, small inflatable activity equipment, and other equipment specifically authorized for use.

Not all equipment is available during every party. Participants may use only designated activity areas and equipment approved by Align Gymnastics staff.

3. ACKNOWLEDGMENT OF RISKS

I understand that gymnastics and recreational physical activities involve inherent and other foreseeable risks, even when activities are supervised and reasonable precautions are taken. These risks include, but are not limited to:

• Slips, trips, falls, and loss of balance.

• Incorrect landings, overrotation, or uncontrolled movement.

• Collisions with other children, staff members, equipment, or surrounding surfaces.

• Injuries while jumping, tumbling, running, climbing, swinging, balancing, or navigating obstacles.

• Falls from gymnastics equipment or raised surfaces.

• Injuries involving Tumbl Trak equipment, mats, or inflatable equipment.

• Equipment movement, improper use, or unexpected participant behavior.

• Injuries resulting from another participant’s actions or failure to follow safety instructions.

Potential injuries include bruises, abrasions, sprains, strains, fractures, dislocations, dental injuries, concussions, head or neck injuries, spinal injuries, and, in rare circumstances, permanent disability, paralysis, or death.

I acknowledge that no physical activity environment can be made entirely free of risk and that staff supervision cannot prevent every injury. I have had an opportunity to ask questions about the activities and participation requirements.

4. ACCEPTANCE OF INHERENT RISKS

With knowledge of the inherent risks described above, I voluntarily authorize my child’s participation in the activities approved by Align Gymnastics. I understand that participation may involve physical exertion, movement on or around equipment, and interaction with other participants.

This acknowledgment is not intended to waive any legal rights belonging to my child that cannot lawfully be waived under Georgia law.

5. STAFF SUPERVISION AND PARENT/GUARDIAN RESPONSIBILITIES

Align Gymnastics staff will be present to supervise and manage birthday party gymnastics activities. Depending on the child’s age, developmental readiness, the planned activities, staffing, and individualized support needs, Align Gymnastics may determine that additional parent, guardian, or caregiver supervision or assistance is reasonably necessary.

If I am advised that a responsible adult must remain on-site or provide specified assistance, I agree to comply with those arrangements as a condition of my child’s participation, subject to applicable reasonable accommodation requirements.

If I am permitted to leave the facility, I agree to remain reachable through the contact information provided and to follow applicable pickup and emergency procedures. I understand that Align Gymnastics staff supervision does not necessarily constitute individualized one-on-one care.

Nothing in this section relieves Align Gymnastics of any duty of care imposed by applicable law.

6. PARTICIPANT SAFETY RULES

I understand and agree to explain age-appropriate safety expectations to my child, including:

• Follow staff instructions promptly.

• Use only approved equipment and designated activity areas.

• Do not attempt flips, advanced skills, or other activities without staff authorization.

• Do not push, shove, engage in rough play, or intentionally interfere with other participants.

• Do not enter restricted areas or use equipment without permission.

• Report injuries, discomfort, or unsafe conditions to staff promptly.

• Follow applicable footwear, clothing, food, and personal-item restrictions.

Align Gymnastics may modify activities, redirect behavior, or temporarily discontinue participation when reasonably necessary to address safety concerns, consistent with applicable law and reasonable accommodation obligations.

7. HEALTH INFORMATION AND PARTICIPATION SUPPORT

I agree to communicate information reasonably necessary for safe participation and emergency response, including relevant activity restrictions, emergency instructions, or assistance needs.

I understand that Align Gymnastics may request clarification of functional support needs or discuss reasonable accommodations when appropriate. A disability or diagnosis alone does not automatically disqualify a child from participation or require additional liability waivers.

Health and support information will be requested and used only as reasonably necessary for participation, safety, accommodations, or emergency response, and handled in accordance with applicable privacy obligations and Align’s information-handling procedures.

8. EMERGENCY MEDICAL AUTHORIZATION

If my child becomes injured or experiences a medical emergency, I authorize Align Gymnastics staff to contact emergency medical services and provide reasonable assistance within their training while professional help is obtained.

If I cannot be reached promptly, I authorize emergency medical personnel to evaluate and provide treatment to my child as permitted by applicable law.

I understand that Align Gymnastics staff are not necessarily licensed medical professionals and that this authorization does not require staff to provide treatment beyond their training.

I understand that medical providers may charge for services and that financial responsibility for such charges is determined by applicable law and the relevant insurance arrangements.

9. RELEASE OF SIGNING ADULT’S OWN CLAIMS

To the fullest extent permitted by Georgia law, I, individually and on my own behalf, release Align Gymnastics, LLC and its owners, officers, members, managers, employees, coaches, and authorized agents from claims belonging to me personally for bodily injury or property damage arising from my own presence at or participation in permitted activities at the facility, including claims based on ordinary negligence, to the extent such claims may lawfully be released.

This provision does not purport to release claims for gross negligence, reckless or willful misconduct, intentional wrongdoing, or other liability that cannot lawfully be released.

This provision does not purport to release my child’s independent legal claims.

10. CHILD’S CLAIMS AND LEGAL RIGHTS

The parties acknowledge that Georgia law may limit the ability of a parent or legal guardian to release a minor child’s personal injury claims before an injury occurs.

Nothing in this agreement is intended to extinguish rights that cannot lawfully be waived or to impose an unenforceable release of the minor’s independent claims.

The parties intend that the valid consent, acknowledgment, authorization, and other lawful provisions of this agreement remain effective independently of any provision found unenforceable.

11. PHOTOGRAPHY AND PUBLICITY

Participation in a birthday party does not constitute permission for Align Gymnastics to use a child’s image, likeness, or voice in public advertising, social media, or promotional materials. Any such permission must be obtained through a separate, optional authorization.

12. GOVERNING LAW AND SEVERABILITY

This agreement shall be interpreted under the laws of the State of Georgia, subject to applicable federal law. If a provision is determined to be invalid or unenforceable, the remaining provisions shall remain effective to the extent permitted by law.

13. ACKNOWLEDGMENT AND SIGNATURE

By signing below, I acknowledge that:

• I have read this agreement.

• I understand the nature of the activities and the described risks.

• I authorize the identified minor to participate.

• I understand the applicable supervision and safety requirements.

• I have had the opportunity to ask questions.

• I am signing voluntarily and represent that I have authority to provide this consent.
